Another issue in a Los Angeles sexual battery charge is the degree of helplessness on the part of the victim. The California Penal Code mentions several degrees of sexual battery. At the lowest end of the scale, simply touching the intimate parts of another person against his or her will is misdemeanor sexual battery. This charge assumes that the victim was aware of the touching and was able to state any objections to the activity, and restrain or otherwise remove the unwanted touch. Should the victim be restrained, unconscious or not mentally competent, the State of California deals with the allegation more severely. What is at Stake in a Sexual Battery Case?If tried as a felony, a sexual battery conviction results in a prison sentence, set according to California’s determinate sentencing guidelines. For most types of felony sexual battery, a conviction will result in two, three or four years in state prison. Aggravating factors in the case, such as the age of the victim and previous convictions, are taken into consideration when sentencing is set. In addition to the prison sentence, a fine of up to $10,000 may be levied against those convicted of felony sexual battery. In most cases, a misdemeanor sexual battery conviction can result in incarceration in the county jail for one year. However, simple sexual battery, in which the victim is not restrained and is aware of the inappropriate touching, carries a jail sentence of six months. In either case, a fine of up to $2,000 can be levied against the accused in addition to any jail sentence.
