A key component of a rape is the concept of consent. Without the informed consent of both parties, a sex act is rape. A number of situations are recognized by the Penal Code of California as rape. Here is a partial list of the situations that the state recognizes as rape:

• When one party is developmentally or mentally unable to give informed consent
• When sexual intercourse is accomplished through force, violence or threat of injury
• When a person cannot resist because of the use of a drug or intoxicating substance
• When the alleged victim is asleep or unconscious (such as an alleged GHB drugging)

Statute of Limitation for Rape Charges

The statute of limitations for sex offenses, such as rape, statutory rape, date rape and other forms of non-consensual sexual assault, vary depending on the exact circumstances surrounding the alleged crime.

• In California, some charges of rape have no statute of limitations and can be brought years later.
• Other rape charges involving two adults must be brought within six years of the alleged commission of the offense.
• California provides a DNA exception for making charges of rape, which can extend the statute of limitations rape cases by up to 10 years from commission to one year after the suspect has been identified by DNA— whichever is longer.

Rape is a felony offense and therefore falls under California’s determinate sentencing guidelines. Depending on the exact charges, under the California sex offense laws, a conviction of rape can result in serious prison sentences.

• Rape carries a felony prison term of 3, 6 or 8 years.
• Rape in concert carries a felony prison term of 5, 7 or 9 years
• Prior felony convictions can increase prison sentences
