These are just some of the possible incarceration periods for those convicted of sex crimes in California:

  • Pimping: Three, four, or six years in state prison if the prostitutes are over the age of 16; three, six or eight years if the prostitutes are minors.
  • Rape: Three, six, or eight years in state prison; an additional term of three to five years if the alleged victim sustained serious injuries.
  • Possession of child porn: Anywhere from 16 months to eight years in state prison.

Court-Ordered Counseling

In some cases, a judge will order mandatory counseling for a convicted sex offender. The offender must attend all scheduled sessions and follow the instructions of the counselor or therapist. If he or she does not comply with the counseling portion of the sentence, this could lead to a revocation of parole or probation, landing the offender back in jail.

Probation/Parole

Sex offenders released on parole or given probation must comply with a number of restrictions. Before an offender is sentenced, he or she undergoes a presentencing investigation. Court officials gather information about the offender to help determine the best sentence. Presentence investigation reports include the following information:

  • Arrest and conviction record of the offender;
  • Personal and sexual history of the offender;
  • Psychiatric evaluations of the offender;
  • Interviews with employers, friends, family members, and roommates of the offender;
  • The level of risk of the offender;
  • Victim impact statements; and
  • Evaluation of the offender's possible success with specialized treatment.

During parole or probation, an offender must report to an officer on an established schedule and may have to submit to mandatory drug and AIDS testing. The parole or probation officer may also impose additional restrictions.

Sex Offender Registration

Section 290(b) of the California Penal Code requires that anyone designated a sex offender register with the chief of police in the city in which he or she resides. If the offender's city has no police department, or the area is unincorporated, he or she must register with the county sheriff. This registration must take place within five days of coming into the area or changing residences within the area. If a convicted sex offender is entering a California State University or community college campus, or plans to reside on campus, he or she must also register with the chief of campus police.

Those who register as sex offenders are stigmatized and sometimes even harassed by members of the community. Registering as a sex offender makes it difficult to find employment and join any activity that requires a criminal background check, such as volunteering for a favorite charity or participating in a child's school events.
